KARACHI: In a significant judgment, the Sindh High Court (SHC) declared the Sindh Building Control Authority's (SBCA) decision to seal former President of Pakistan Dr. Arif Alvi's dental clinic null and void. In the detailed written verdict, the court emphasized that the SBCA violated fundamental rights by failing to provide a notice or opportunity to rectify the issue before sealing the clinic.
The SHC directed the SBCA to immediately de-seal the clinic. The petitioner, Dr. Alvi, has been instructed to approach the SBCA within 10 days to request a change in the plot's status. The SBCA, in turn, is mandated to decide on the matter within 45 days.
Background
The dental clinic of former President Dr. Arif Alvi was sealed by the SBCA in October 2024 on grounds of alleged land-use violations. The SBCA claimed the clinic was operating in a residential area without proper permissions. Dr. Alvi contested this action, citing procedural irregularities and a lack of communication from the SBCA.
Last week, the SHC ordered the de-sealing of the clinic, but the process faced delays due to ongoing legal procedures. Dr. Alvi's petition highlighted the SBCA's failure to adhere to legal protocols, ultimately leading to the court's ruling in his favor.
This development is significant, given the clinic's operational history and its connection to a prominent public figure. The case raises broader questions about regulatory oversight and procedural fairness in governance.
